Public Charge- What Families Need to Know

The U.S. Department of Homeland Security recently finalized a rule which will make it easier to deny an immigrant’s application to enter the United States, obtain a visa, or adjust their immigration status (e.g., receive a Green Card) on the grounds that they are likely to become a “public charge.” The rule has the potential to spread fear and confusion among immigrant families who may wish to access public assistance (including Free/Reduced Prices Meals and other student services at school). The rule change goes into effect Oct. 15, 2019.

Benefits that many of our families utilize that WILL NOT be counted in a public charge test include the following:

  • School meals
  • Special Education
  • School-based Health Services
  • Food from the Food Bank
  • WIC (nutrition assistance for women, infants, and children to age 5)
  • Oregon’s Cover All Kids Program
